§ 1General ProvisionsThis Privacy Policy sets out the rules for the processing of personal data of persons using the legaliscompany.com website and persons to whom Legalis Company Polska provides advisory and intermediary services in the field of legalisation of stay, obtaining visas and registration of business activity.
The Administrator makes every effort to ensure that the processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: GDPR), as well as the Act of 10 May 2018 on the Protection of Personal Data.
§ 2Personal Data ControllerThe Administrator of personal data is Legalis Company Polska spółka z ograniczoną odpowiedzialnością with its registered office in Łódź, Aleja Tadeusza Kościuszki 59/61, 90-514 Łódź, entered in the register of entrepreneurs of the National Court Register under KRS number 0000877062, NIP 7252305180, REGON 387848990, conducting business activity at the following addresses:

§ 3Purposes and Legal Bases for Processing Personal DataPersonal data are processed for the following purposes:
Provision of advisory and intermediary services (obtaining temporary residence permits, residence cards, EU long-term resident cards, visas for the United Kingdom and Canada, services for employers hiring foreign nationals, and registration of business activity) on the basis of Article 6(1)(b) GDPR, i.e. for the performance of a contract with the client or to take steps at the client’s request prior to entering into a contract, and, insofar as the law imposes on the Controller an obligation to prepare and submit documents on behalf of the client, also on the basis of Article 6(1)(c) GDPR.
Handling enquiries submitted by telephone, e-mail, through the contact form on the website or via messengers on the basis of Article 6(1)(f) GDPR, as a legitimate interest of the Controller consisting in responding to enquiries addressed to it, and, insofar as the person making contact voluntarily provides personal data in the content of a message, on the basis of Article 6(1)(a) GDPR.
Compliance with legal obligations imposed on the Controller, in particular obligations arising from tax and accounting regulations and regulations concerning the prevention of money laundering and terrorist financing, where applicable, on the basis of Article 6(1)(c) GDPR.
Establishment, exercise or defence of claims on the basis of Article 6(1)(f) GDPR, as a legitimate interest of the Controller.
Direct marketing of the Controller’s own services, including publication of client reviews on the website and social media, on the basis of Article 6(1)(a) GDPR, solely with the consent of the data subject.
Where, in the course of providing legalisation and visa services, it is necessary to provide information concerning criminal records or other data required by immigration authorities, consulates or embassies of third countries, such data are processed on the basis of Articles 6(1)(c) and 6(1)(f) and Article 10 GDPR, to the extent determined by the provisions applicable to the relevant procedure.
§ 4Categories of Data ProcessedDepending on the type of service, the Administrator may process, in particular:
- identification data (first name, surname, date of birth, citizenship, series and number of identity document, PESEL number),- contact details (residential or stay address, telephone number, e-mail address),- data concerning residence status and the history of legalisation of stay in Poland,- data concerning employment and conducted business activity,- copies of documents provided by the client for the purpose of preparing official applications,the content of correspondence conducted with the Administrator.
Data are obtained directly from the person concerned and, in the case of clients referred by an employer, also from the entity commissioning the service, provided that the person has been informed thereof.
§ 5Data RecipientsPersonal data may be transferred to:- competent offices and public administration authorities, including the Office for Foreigners, voivodeship offices, the Social Insurance Institution, tax offices and the Central Register and Information on Business Activity, to the extent necessary for conducting proceedings in which the Administrator represents or supports the client,- consulates and embassies of the United Kingdom and Canada and visa centres acting as intermediaries in accepting visa applications,entities providing accounting, legal, IT and hosting services to the Administrator, on the basis of - - concluded agreements entrusting the processing of data,providers of analytical tools and social media platforms, to the extent described in the section concerning cookies.
The Administrator does not transfer personal data to other entities for marketing purposes without the explicit consent of the data subject.
§ 6Transfer of Data to Third CountriesIn connection with the handling of visa applications for the United Kingdom and Canada, personal data may be transferred to countries outside the European Economic Area, to the extent necessary for the submission and consideration of a visa application by the competent authorities of those countries. The transfer takes place on the basis of Article 49(1)(b) and (c) GDPR, as necessary for the performance of a contract concluded with the client or taking steps at their request prior to entering into a contract, and for the establishment, pursuit or defence of claims.
§ 7Data Retention PeriodPersonal data are stored for the period necessary to fulfil the purpose for which they were collected, in particular for the duration of the cooperation and for the limitation period of any claims arising from civil law.
Data processed on the basis of tax and accounting obligations are stored for the period required by the applicable regulations. Data processed on the basis of consent are stored until the consent is withdrawn.
§ 8Rights of Data SubjectsThe data subject has the right to:
- access their data and receive a copy thereof,- rectify inaccurate or incomplete data,- erase data, in the cases provided for in Article 17 GDPR,- restrict the processing of data,- data portability, insofar as they are processed in an automated manner on the basis of a contract or consent,- object to the processing of data based on the legitimate interest of the Administrator,withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal,- lodge a complaint with the President of the Personal Data Protection Office if the person considers that the processing of their data violates the provisions of the GDPR.
§ 9Voluntary Provision of DataProviding personal data is voluntary; however, in the case of services consisting in the preparation and submission of official, visa or registration applications, providing the data specified by the Administrator is necessary for the performance of these services. Refusal to provide the data may make their performance impossible.
§ 10Automated Decision-MakingThe Administrator does not make automated decisions concerning data subjects, including decisions resulting from profiling within the meaning of Article 22 GDPR.
§ 11CookiesThe legaliscompany.com website uses cookies, i.e. small text files stored on the user's device, in order to ensure the proper functioning of the website, adapt it to the user's preferences, and for statistical and analytical purposes.
Cookies are divided into:
